Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Surggies (the “Service”), a product operated by SurgingMarkets (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. Surggies is in early access; features and these Terms may change as the product evolves.

1. Who can use Surggies

You must be at least 13 years old (or the minimum digital consent age in your country) to use the Service. If you use Surggies on behalf of a company, you confirm you have authority to bind that company to these Terms.

2. Your account

You are responsible for your account and for keeping your credentials secure. You agree to provide accurate information and to notify us of any unauthorized use. You may register a free account, a demo account, or a paid subscription.

3. Bring your own AI key (BYOK)

Surggies can run on AI provider keys you supply. When you connect your own key, you are responsible for your usage and any charges your AI provider bills you. We pass your prompts to the provider you configured solely to perform the action you requested. We never sell or share your keys.

4. AI agents and delegated actions

Surggies lets you delegate tasks to AI agents (“running a delegation”). AI output can be wrong, incomplete, or unsuitable. You are responsible for reviewing agent output before relying on it. Do not use the Service for anything unlawful, harmful, or that violates a third party’s rights.

5. Subscriptions and billing

Paid plans are billed in advance on a recurring basis (for example, monthly) through our payment processor. Prices shown during early access are indicative and may change before general availability; we will give notice of price changes that affect an active subscription. You can cancel at any time from your account — see our Refund Policy for what happens to the remainder of a billing period.

6. Acceptable use

You agree not to: reverse engineer or disrupt the Service; attempt to access accounts or data that are not yours; use the Service to generate spam, malware, or abusive content; or circumvent usage limits. We may suspend accounts that put the Service or other users at risk.

7. Your content

You keep ownership of the data and content you put into Surggies (your territories, configurations, prompts, and results). You grant us a limited license to store and process that content only as needed to operate the Service for you.

8. Intellectual property

Surggies, its pixel art, characters, code, and branding are owned by SurgingMarkets and protected by law. These Terms do not grant you any right to our trademarks or assets beyond using the Service as intended.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or fit for any particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, SurgingMarkets will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

12. Changes to these Terms

We may update these Terms as the Service grows. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
